X-cotec Terms of Sale

These Terms of Sale apply to all purchases made on the X-cotec website, operated by SLIVER TREE SARL. By placing an order, you agree to these Terms of Sale.

1. Order Acceptance and Contract Formation
When you place an order, you are making an offer to purchase. A contract of sale is formed only when we send you an order confirmation email and successfully process your payment. We reserve the right to decline or cancel any order for reasons including, but not limited to, product unavailability, errors in pricing or product information, or suspicion of fraudulent activity. If we cancel your order, we will issue a full refund.

2. Prices and Taxes
All prices displayed on the website are in Euros (EUR) and include Value Added Tax (VAT) for consumers within the European Union. Shipping costs are displayed separately at checkout before you complete your purchase. Prices are subject to change without notice, but the price charged will be the price displayed at the time your order is placed.

3. Payment
We accept payments via major credit cards (Visa, Mastercard, American Express), Apple Pay, Shop Pay, and PayPal. Payments are processed securely through Shopify Payments and its third-party providers. By providing your payment details, you represent that you are authorized to use the chosen payment method.

4. Transfer of Ownership and Risk
For consumers in France and the European Union, the risk of loss or damage to the goods passes to you when you (or a third party designated by you, other than the carrier) take physical possession of the goods. Title to the goods passes to you upon full payment.

5. Right of Withdrawal and Returns
As a consumer in the EU, you have a statutory right to withdraw from the contract within 14 days of receiving your goods, without giving any reason. To exercise this right, you must notify us by email at lwuk8111@xcotec.eu before the withdrawal period expires. The direct cost of returning the goods is borne by you. 6. Legal Guarantees
All products sold by X-cotec benefit from the legal guarantee of conformity (2 years from delivery) and the guarantee against hidden defects under French and EU law, as detailed in our Terms of Service. Commercial warranties offered by brands (e.g., 1-year warranty) are in addition to and do not replace these statutory rights.

7. Limitation of Liability
Nothing in these Terms of Sale limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law. Our liability for any breach of contract is limited to the purchase price of the product(s) you purchased, to the fullest extent permitted by law. This does not affect your mandatory consumer rights.

8. Governing Law and Disputes
These Terms of Sale are governed by French law. As a consumer, you benefit from the mandatory provisions of the law of your country of residence. Any disputes arising from these Terms of Sale may be brought before the competent courts in France or your country of residence, in accordance with applicable consumer protection laws.
